*General Terms and Conditions for Students and Instructors*

*1. Applicability*

These General Terms and Conditions (“Terms”) apply to all students and instructors franchised by KA Driver Training (“the Company”). By enrolling in or accepting franchise with the Company, students and instructors agree to be bound by these Terms.

*2. Definitions*

– “Company” means KA Driver Training.

– “Instructor” means a self employed DVSA approved driving instructor working with the Company under franchise to provide driver training services.

– ⁠”Student” means an individual enrolled in the Company’s driver training program.

– “Lessons” means the driving instruction sessions provided by the Company.

– “Fees” means the monetary consideration paid by students for lessons.

*3. Student Enrollment*

– Students must be at least 17 years of age to enroll in the Company’s driver training program.

– Students must provide valid driver’s licence

– Students must be able to read a vehicle number plate from approximately 20m

– ⁠Students must not be under the influence of alcohol or drugs and any medication that may impact their ability to drive safely

– Students must either switch off their mobile devices or have these on silent mode for the duration of their driving lessons

– The Company reserves the right to refuse enrollment to any applicant at its discretion.

*4. Instructor Employment*

– Instructors must be at least 21 years of age and possess a valid driver’s licence and registration of Approved driving instructor with DVSA

– Instructors must pass a background check and provide proof of insurance.

– When giving paid tuition to any driver, the Instructor must display their DVSA issued Certificate or badge

– The Company reserves the right to terminate the employment of any instructor at its discretion.

*5. Lessons*

– Lessons are typically 2 hours in duration and are scheduled at the convenience of both the student and instructor.

– Instructors will provide instruction in accordance with the DVSA driver’s curriculum in a dual controlled fully insured car

*6. Fees*

– Fees must be paid in advance of lessons either by cash or bank transfer

– Refunds will only be issued for lessons that are cancelled with an appropriate notice

– The Company reserves the right to change its fee structure at any time.

*7. Safety*

– Safety is the Company’s top priority.

– Students and instructors must obey all traffic laws and regulations

– Students must follow the instructions of the instructor.

– The Company reserves the right to suspend or terminate lessons if safety concerns arise.

*8. Conduct*

– Students and instructors are expected to conduct themselves respectfully and professionally.

– Harassment, discrimination, or disruptive behavior will not be tolerated.

– The Company reserves the right to take disciplinary action against students or instructors who violate this policy.

*9. Liability*

. The Company is not liable for any accidents or damages that may occur during lessons.

– Students and instructors are responsible for their own actions and decisions

*10. Termination*

– Students may terminate lessons at any time with written notice.

– The Company may terminate lessons if the student violates these Terms or for any other reason at its discretion.

– Refunds will not be issued for lessons that are terminated or cancelled by the student if appropriate cancellation notice of at least 48hrs is not received by the company or Instructor

*11. Modifications*

– The Company reserves the right to modify these Terms at any time.

– Students and instructors will be notified of any such modifications in writing.

*12. Governing Law*

– These Terms shall be governed by and construed in accordance with the laws of the scotland

*13. Entire Agreement*

– These Terms constitute the entire agreement between the Company and students and instructors and supersede any prior agreements or understandings.
